The President of the European Patent Office, having regard to Rule 2 EPC and Rule 89bis.1 and 2 PCT, has decided as follows:

Article 1 Admissibility of electronic filing

(1) Documents in proceedings under the EPC may be filed with the European Patent Office in electronic form.

(2) European patent applications may also be filed in electronic form with the compe- tent national authorities of those contracting states which so permit.

Further to the decision dated 26 February 2009 concerning the electronic filing of documents 1, and having regard to Rule 2 EPC and Rule 89bis.1 and 2 PCT, the President of the European Patent Office has decided as follows:

Article 1 Software to be used for electronic filing

(1) Electronic filings in accordance with Article 5 of the above-mentioned decision dated 26 February 2009 shall be made using version 4 (build 4.228) or later releases of the EPO Online Filing software.

Agreement between the EPO and WIPO under the PCT

Pursuant to Article 11(2) of the Agreement between the EPO and WIPO under the PCT 1, Annex A to the agreement has been amended2 with effect from 1 March 2009. The text of Annex A as amended is published below.

Annex A Languages and kinds of application

Under Article 3 of the Agreement, the Authority specifies:

(1) the following languages which it will accept: English, French, German, and where the receiving Office is the industrial property Office of Belgium or the Netherlands, Dutch.

The President of the European Patent Office, having regard to Rules 53(2) and 163(2) of the European Patent Convention (EPC), has decided as follows:

Article 1 Inclusion of a copy of the previous application in the file of a European patent application

The European Patent Office shall include free of charge in the file of a European patent application a copy of the previous application from which priority is claimed if the previous application is:

(a) a European patent application,

Introduced in July 2007, the payment plan function offers users of Online Fee Payment an overview of all the applications to which the automatic debiting procedure applies.

Users now have the added option within the payment plan of setting up and cancelling automatic debit orders online.

To set up an order, the user enters the application number. Once the order has been transmitted to the EPO, the user receives on-screen confirmation in PDF format. If no confirmation appears, the debit order is regarded as not received and the payment is regarded as not made.
