1. In view of the current tragic events in the USA, the Caribbean and Mexico, attention is drawn to the general legal remedies provided under the European Patent Convention in case of non-observance of time limits and, more specifically, to Rule 134(5) EPC.

I. Background

The European Patent Office (EPO) and the Ministry of Industry, Foreign Trade and Services of Brazil, signed on 17 October 2016 a Joint Statement enabling the EPO and the National Institute of Industrial Property of Brazil ("INPI") to launch a Patent Prosecution Highway pilot programme.
