OJ EPO 2013, 438 - Communication from the Enlarged Board of Appeal concerning case G 1/13

In accordance with Article 112(1)(a) EPC, Technical Board of Appeal 3.3.07 referred the following points of law to the Enlarged Board of Appeal with interlocutory decision of 21 June 2013 in case T 22/09:

Where an opposition is filed by a company which is dissolved before the Opposition Division issues a decision maintaining the opposed patent in amended form, but that company is subsequently restored to the register of companies under a provision of the national law governing the company, by virtue of which the company is deemed to have

OJ EPO 2013, 444 - Notice from the EPO about the improved new online edition of its Official Journal

From January 2014, the EPO's Official Journal will be available online in thoroughly revised form. It will provide the same information, but will be better structured, continuously updated and more user-friendly. In particular, it will offer improved and easier access to the information. When the new online OJ comes in, as from 1 January 2014, the hard-copy edition will be discontinued.

OJ information will then be available only via the EPO website (www.epo.org) in HTML and PDF. The EPO's online OJ service will remain free of charge.

OJ EPO 2013, 449 - Notice from the European Patent Office dated 10 September 2013 concerning the staying of proceedings due to referrals G 2/12 and G 2/13

1. Referral G 2/12 ("Tomatoes II") is pending before the Enlarged Board of Appeal. In addition, further questions of law have recently been referred to the Enlarged Board of Appeal with interlocutory decision of 8 July 2013 in case T 83/05 . This referral is pending as case G 2/13 ("Broccoli II"). This questions seek, in particular, to clarify whether the exclusion of essentially biological processes for the production of plants may affect the allowability of product claims directed to plants or plant material.
