The ultimate responsibility for ensuring that the title accords with the provisions of the Implementing Regulations rests with the examining division. The search division will nevertheless take action and amend the title to avoid, if possible, the publication of applications having titles which obviously do not comply with the applicable EPC provisions (see also F‑II, 3). In these cases, the EPO will of its own motion change the title, if this appears necessary (see OJ EPO 1991, 224).[Rule 41(2)(b); ]
The applicant is informed of whether the title proposed has been approved by the search division upon transmission of the European search report. The wording of the title (in the three official languages of the EPO), as approved by the search division, is notified by the communication announcing the forthcoming publication.
The title of the invention will be published and entered in the European Patent Register (Rule 143(1)(c)) in capital letters.
