OJ EPO 2015, A18 - Decision of the President of the European Patent Office dated 5 February 2015 fixing the amount of the fee for validating European patent applications and patents in Morocco

The President of the European Patent Office,

Having regard to the agreement signed on 17 December 2010 between the European Patent Organisation and the Kingdom of Morocco on the validation of European patents,

Having regard to Moroccan Law No. 17-97 on the protection of industrial property, as amended and supplemented by Law No. 23-13 promulgated on 21 November 2014,

Having regard to Decree No. 2-00-368 implementing that law, as amended and supplemented by Decree No. 2-14-316 adopted on 15 January 2015,

Having regard to the order issued on 19 January 2015 by Morocco's Minister for Industry, Trade, Investment and the Digital Economy, designating the European Patent Office as validation authority,

Having regard to the information notice dated 19 January 2015 from the Director-General of the Moroccan Industrial and Commercial Property Office (OMPIC) on the procedure for validating European patents in Morocco,

Having consulted the Director-General of OMPIC,

Has decided as follows:

Article 1

The fee[ 1 ] for validating European patent applications and patents in Morocco is fixed at EUR 240.

Article 2

If the validation fee is paid late, an administrative surcharge[ 2 ] of 50% of the amount specified in Article 1 must be paid at the same time.

Article 3

The fees under Articles 1 and 2 apply to payments made as from 1 March 2015, the date of entry into force of the validation agreement signed between the government of Morocco and the European Patent Organisation.

Article 4

This decision enters into force on 1 March 2015.
